1. Introduction and Controller Identity

Delta Electronics (Netherlands) B.V. and its direct and indirect subsidiaries (collectively, "Delta Electronics," "we," "us," or "our") are committed to safeguarding the privacy of all individuals whose personal data we process.

This Unified Privacy Policy explains how we collect, use, disclose, store, and protect your personal data in compliance with the EU General Data Protection Regulation (Regulation (EU) 2016/679) ("GDPR"), the UK General Data Protection Regulation ("UK GDPR"), and all other applicable data protection laws.

The data controller responsible for processing your personal data is the specific Delta Electronics entity with which you interact — whether as a website visitor, customer, job applicant, event attendee, outsourced personnel, or vendor. The Delta Electronics entities that may act as controllers include Delta Electronics (Netherlands) B.V. and its subsidiaries, including but not limited to Delta Electronics (Switzerland) A.G., Delta Solutions (Finland) Oy, Delta Electronics (France) S.A., Delta Electronics (Poland) Sp. z o.o., Delta Electronics (Czech Republic) spol. s r.o., Delta Electronics Solutions (Spain) S.L., Delta Electronics (Italy) S.r.l., and Delta Electronics Europe Limited.

This policy does not cover the commercial practices of other companies and organizations that advertise our service.

 

2.  Scope and Application 

This Policy applies to the processing of personal data of the following categories of individuals ("data subjects"):

● Website visitors: Individuals who visit Delta Electronics websites, including the BeSmart platform and EMEA regional websites.
● Customers: Individuals or business contacts who use Delta Electronics' products, services, or applications.
● Job applicants: Individuals who apply for positions within Delta Electronics.
● Event attendees: Participants, guests, and attendees of events organized, hosted, or participated in by Delta Electronics.
● Vendors: Individuals or business contacts within organizations that supply goods or services to Delta Electronics, whose personal data may be processed in the context of contractual or business relationships.
● Outsourced personnel: Individuals engaged under service contracts through outsourcing agencies.

This Policy applies to personal data in any form, whether oral, electronic, or written.
 
While this Policy is intended to describe the broadest range of our personal data processing activities, those activities may be more limited in some jurisdictions based on the restrictions of their laws. In those instances, we adjust our internal policies and practices to reflect the requirements of local law. 

 

3.  Personal Data We Collect

In this Policy, "personal data" means any information that identifies you or can be used to identify you, directly or indirectly. The specific types of personal data we process vary depending on your relationship with us, your role, local legal requirements, and operational needs. 
 

3.1 Website Visitors

We collect the following personal data when you interact with our websites:
Personal Identifiable Information (PII): Name, email address, company name, job title, contact method, and other details you provide through forms or communications. 
Technical Data: IP address, browser type and version, operating system, referral source, pages viewed, time of use, and other browsing information collected through server log files. 
Cookies and Similar Technologies: Data collected through cookies and similar technologies to enhance user experience and analyze website usage. For detailed information, please refer to Section 12 of this Policy. 

We collect this data through direct interactions (e.g., filling out forms, subscribing to newsletters, communicating with us) and automated technologies (e.g., information collected automatically as you navigate the site). 

 

3.2 Customers

We collect personal data from customers in order to provide products, services, newsletters, technical support, applications, promotion activities, events, and product information. This includes: 

 Contact and identification information: Name, email address, home address, telephone number, company name, company address, and job position. 
Account information: Personal data required to set up a user account for unique applications (e.g., EV charger, UPS, PV inverter monitoring, maintenance, and control systems). 
Location information: Data about product locations for the purpose of providing on-site monitoring services, collected through technologies such as IP address and GPS. 
Log information: Details include but are not limited to how you used our applications, telephony log information, internet protocol address, time and date of login, and device information. 

 

3.3 Job Applicants


We collect personal data during the recruitment and hiring process (information you provide directly through Delta Electronics’ recruitment systems or that we receive from authorized third parties such as recruitment agencies or platforms you have instructed to share your information with us), including: 

Identification details: Name, nationality, gender, date of birth, and similar basic identifiers.
Contact information: Phone number, email address, and home address.
CV/résumé information: Work experience, employment dates, promotions, qualifications, technical skills, education, certifications, languages, training courses, photo, driving license, special vehicle qualifications, and marital status.
Interview notes and assessments.
Information from recruitment agencies or job platforms, where applicable.
Source information, such as how you learned about the job opportunity.
Residency or work permit information, where relevant.
Communications created during the recruitment process, including voicemails, emails, and online meeting records (e.g. Microsoft Teams, Skype) created during the recruitment process.
References or recommendations.
Security-related information, e.g., CCTV during on-site interviews or visits to Delta Electronics’ offices.
Any additional information you voluntarily provide during your application.
Sensitive information, such as data revealing racial or ethnic origin, religious beliefs, sexual orientation, health information, or criminal history – only if you voluntarily provide it or if we are required to collect it by law.

If you receive and accept an employment offer, we will collect additional data necessary for the employment relationship, which may include:

Identification details, such as name, nationality, gender, and date of birth.
Official documentation, including national ID or passport, work permits, social security numbers, or taxpayer/government identifiers where legally required.
Personal life information, such as family status or dependents (for benefits or insurance purposes)
Bank account details, tax information, and other data needed to process payroll, benefits, and statutory payments.
Documentation required under immigration, labor, or social security laws.
Sensitive personal information, processed only in accordance with local laws, such as:  
Health or disability information (for workplace accommodations).
Information required to meet anti-discrimination laws or diversity reporting obligations (e.g., race, ethnicity, religion, or sexual orientation).
Information needed to comply with legal requests, such as child support orders or debt related court directives.  

If you choose to create your application profile using information stored with third party platforms (e.g., LinkedIn, Indeed), those platforms may provide us with certain personal information. Their handling of your personal information is governed by their own privacy policies.

Most of the personal information we process is provided directly by you. We may also process: 

● Information inferred from your interactions with us (e.g., interview notes). 
● Information obtained from third parties, but only through processes we have informed you about. 
 
Some of the personal information described above may be classified as “Sensitive Personal Information” under certain privacy laws. These laws typically include information revealing racial or ethnic origin, political opinions, religious or similar beliefs, trade union or professional association membership, physical or mental health, genetic data, sexual life or sexual orientation, and criminal convictions or alleged offenses. 
 
We only process Sensitive Personal Information where necessary, and only if permitted under applicable law. In jurisdictions where explicit consent is required, your acceptance of this Policy constitutes your express written consent for Delta Electronics to process any Sensitive Personal Information or financial information you provide, to the extent permitted by local law. 


3.4 Event Attendees


We collect personal data during the recruitment and hiring process (information you provide directly through Delta Electronics’ recruitment systems or that we receive from authorized third parties such as recruitment agencies or platforms you have instructed to share your information with us), including:
 
We collect the following personal data in connection with events: 
 Personal Identifiable Information: Full name, email address, occupation, and phone number.
Event-Related Data: Attendance status, registration details, preferences (e.g., dietary requirements), and activity participation.
Media: Photographs, videos, or audio recordings taken during the Event (with your consent).
Feedback and Surveys: Responses to post-event feedback or surveys.
Visa Support Data: In limited cases and only at the participant's request, passport details for the purpose of issuing official invitation letters for the visa application process.

We may also collect any other personal data that you voluntarily provide to us for the purpose of facilitating your participation in the Event. This may include additional preferences or specific requests related to the Event. 

We collect personal data through the following methods: 
Registration Forms: When you register for the Event, we collect your contact details and, if applicable, preferences; 
● In-Person and Digital Interactions: Information is collected during the Event, including media captured through photography or videography; 
Exhibition and Lead Collection Activities: During exhibitions, we may collect business contact information from visitors who engage with us, through the manual collection of business cards, or through digital lead capture tools provided by event or exhibition organizers (such as QR code or badge scanning). 
Feedback and Communication: We may collect additional data when you respond to Event-related communications or provide feedback. 


3.5 Outsourced Personnel 

We collect the personal data necessary to administer your service engagement and create secure system accounts, including: full name, gender, date of birth, onboard date, workplace location, period of service contract, and department.

We may obtain this data directly from you or indirectly from your employer (the outsourcing agency). We do not collect special category (sensitive) data from outsourced personnel unless required by law or explicit consent is obtained.


3.6 Vendors

We collect the following information about you as a vendor:

3.7 Special Category Personal Data

In certain circumstances, the personal data we process may include "special categories of personal data". This may include data revealing racial or ethnic origin, political opinions, religious or similar beliefs, trade-union membership, physical or mental health information, genetic data, biometric data, sexual life or orientation, or criminal offence data. 

We process such data only when strictly necessary, lawful, and permitted under applicable legislation, and only for purposes aligned with our obligations (e.g., employment, workplace safety, anti-discrimination reporting). Where local law requires explicit consent for the processing of sensitive personal data, we will request your consent before processing.

Delta Electronics may operate CCTV systems within and around our offices and factories. If you visit our premises for an interview, your image may be captured by CCTV cameras. The use of CCTV will always comply with applicable laws and is limited to the following purposes:
● Preventing and detecting crime
● Ensuring the health and safety of visitors and staff
● Protecting Delta Electronics’ property and the property of staff, visitors, and third parties
● Protecting Delta Electronics’ property and the property of staff, visitors, and third parties

The legal bases for this processing are our legitimate interests in safeguarding our premises and complying with applicable safety and security regulations.

5. Data Sharing and Disclosures

We share personal data only when necessary, for the purposes described in this Policy, and with appropriate safeguards. We limit access to persons and organizations that need the information, and subject them to confidentiality obligations.

Your personal data may be shared with:
Internal teams: Human Resources, Payroll, Line Managers, Business Leadership, Legal, Compliance, Internal Audit, Finance, IT, Security, or Facilities teams, strictly to the extent required.
Delta Electronics Group companies: For centralized HR administration, workforce planning, IT support and security, or internal reporting.
External service providers (processors): Third-party vendors who assist in operating our websites, conducting our business, providing payroll, benefits and insurance administration, pensions, recruiting and background checks, learning systems, travel and expense platforms, IT hosting/support, physical security systems, event management, catering, and technology partners. All vendors act only on our instructions under Data Processing Agreements with confidentiality, security, sub-processor controls, and data deletion/return obligations.
For vendor-related processing: Personal data may be shared with third parties only where necessary to manage the vendor relationship, such as with banks or payment service providers for the execution of payments, or where required by applicable laws and regulations (e.g., tax authorities).
Public authorities and regulators: Tax, labor, social security, immigration, health and safety authorities, courts, law enforcement, or other regulators, limited to what the law requires.
In the event of a corporate transaction: If we merge, acquire, divest, or reorganize, relevant personal data may be shared with prospective or acquiring entities and their professional advisers under strict confidentiality and only as necessary to evaluate and complete the transaction.
Event-related service providers: Where personal data is collected in connection with events, we may share it with third-party service providers that support the organization and execution of such events. These may include event management companies (for registration, logistics, and on-site services), catering and hospitality providers (to manage guest preferences and dietary requirements), technology partners (to manage event registration, communication, and digital platforms), and marketing providers (for event updates, surveys, and related communications). All such parties act under appropriate contractual safeguards and only for the purposes specified.

We will share your personal information with companies, organizations or individuals outside Delta Electronics if we have a belief in good faith that access, use, preservation or disclosure of your information is reasonably necessary to:
● meet any applicable laws, regulations, legal processes or enforceable governmental requirements;
● enforce our services, including investigation of potential violations;
● detect, prevent possible fraud, infringement of security or technical issues; and
● protect against harm to our rights, property or data security, or other user’s/public safety.

We disclose only the minimum information necessary and only for the specified purposes. All recipients must apply appropriate technical and organizational measures to protect your data.


 
6. International Data Transfers

Delta Electronics primarily hosts systems on servers located in Germany. To ensure efficient operations, some systems may also be hosted in, or remotely accessed from, locations outside the EU/EEA, such as the United States, the United Kingdom, Switzerland, or Taiwan.

Whenever your personal data is transferred outside the EEA, we ensure that appropriate safeguards are in place:
Adequate countries (e.g., United Kingdom, Switzerland): We rely on the European Commission's adequacy decisions.
United States: Where the recipient is certified by the Department of Commerce of the United States, we rely on the EU–US Data Privacy Framework; otherwise we use Standard Contractual Clauses (SCCs) and any supplementary measures required.
Non-adequate countries (e.g., Taiwan): We use SCCs within Intra-Group Data Transfer Agreements. Furthermore, we strictly follow the same data protection standards and security measures everywhere to ensure your personal data is protected from unauthorized access or disclosure.

7. Data Retention

We retain personal data only for as long as necessary to fulfil the purposes for which it was collected, or as required by applicable law. Retention periods are determined based on the following criteria:

● The period required to process and use personal data for the specific purpose for which it was collected.
● The retention period specified in the relevant contract, employment agreement, or applicable internal policies.
● The period required by relevant laws or regulations.
● The period necessary to cooperate with government or judicial investigations, or to support civil, criminal, or administrative proceedings.
● Any applicable statutes of limitations.

Specific retention periods:

Job applicants (talent network): If you consent to join our talent network, your data is retained, in accordance with local law, but no longer than 1 year after consent unless you withdraw earlier.
Customers (newsletter): Until you unsubscribe from our newsletter or request removal.

Once none of the retention conditions apply, we will securely delete or destroy your personal data in accordance with applicable legal and operational requirements.

 

8. Your Rights as a Data Subject

Under the GDPR, you have the following rights regarding your personal data:

Right of Access: You may request confirmation of whether we process your personal data and obtain a copy of that data.
Right to Rectification: You may request correction of inaccurate or incomplete personal data.
Right to Erasure: In certain circumstances, you may request deletion of your personal data (e.g., when data is no longer needed, you withdraw consent, you make a justified objection, or data has been unlawfully processed).
Right to Restriction of Processing: You may request that we limit the processing of your personal data in certain cases (e.g., when you contest accuracy or when processing is believed unlawful).
Right to Data Portability: You have the right to receive your personal data in a structured, commonly used, and machine-readable format and to transmit it to another controller, where processing is based on consent or contract and is carried out by automated means.
Right to Object: You may object to processing based on legitimate interests at any time for reasons relating to your particular situation. We will cease processing unless we can demonstrate compelling legitimate grounds. You have an absolute right to object to processing for direct marketing purposes.
Right to Withdraw Consent: Where processing is based on your consent, you may withdraw that consent at any time. Withdrawal does not affect the lawfulness of processing carried out before consent was withdrawn.
Right Not to Be Subject to Automated Decision-Making: You have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you, unless permitted by law.

How to exercise your rights:

To exercise any of your rights, please contact us at emea-privacy@deltaww.com. For security reasons, we may ask you to provide information to verify your identity. We aim to respond within one month of receiving your request, or within any extended timeframe permitted by applicable law for complex or numerous requests.

We will respond to all legitimate requests free of charge. Where requests are manifestly unfounded or excessive (for example, because of their repetitive character), we may charge a reasonable fee based on administrative costs or refuse to act on the request, in accordance with Article 12(5) GDPR.

10. Data Security

We implement appropriate technical and organizational measures to protect your personal data against unauthorized access, alteration, disclosure, loss, or destruction. These measures include:
